SMS Terms

LOARANA LLC (“LOARANA”, “we”, “us”, “our”) operates a mobile messaging program (the “Program”). By opting in, you agree to these terms and to our Privacy Policy and Terms of Service. These terms apply only to the Program and do not change any other agreement between us.

1. Opting in

You join the Program by affirmatively opting in — typically by entering your mobile number and ticking the consent box on our website, or by texting a keyword to our number.

By opting in you agree to receive recurring automated marketing text messages from LOARANA at the number you provided, including messages sent using an automatic telephone dialing system. Consent is not a condition of any purchase. Message and data rates may apply. Message frequency varies.

2. Opting out

Reply STOP, END, CANCEL, UNSUBSCRIBE or QUIT to any message to leave the Program. You may receive one final message confirming it.

These keywords are the only reliable way to opt out. Our messaging platform may not recognise altered or modified commands — different spellings, or extra words added around the keyword — and other methods, such as asking a member of staff, are not a reliable means of opting out. If a keyword does not appear to work, email Hello@loarana.com and we will remove you manually.

3. What we send

Messages about new harvests and product launches, pre-order openings, Ramadan and seasonal offers, order and delivery updates, and occasional cart reminders.

4. Help

Reply HELP to any message, or email Hello@loarana.com. Note that emailing us is not a valid way to opt out — use the keywords in Section 2.

5. Carriers and delivery

The Program is provided on an as-is basis. It may not be available on every carrier or in every area, and it may stop working if your carrier changes its service. Delivery depends on your wireless provider and is outside our control. Neither we nor any carrier is liable for delayed or undelivered messages. If your device does not support MMS, we will send an SMS instead.

6. Who can participate

You need a wireless device capable of two-way messaging on a participating carrier with text messaging service. You may not join the Program if you are under 13. If you are between 13 and 18, you must have a parent or guardian’s permission. By joining, you confirm you meet these requirements and that participation is lawful where you live.

7. Your messages to us

Do not send content that is fraudulent, defamatory, threatening, harassing, obscene, discriminatory, or unlawful; that contains viruses or harmful code; or that includes protected health information under HIPAA or the HITECH Act.

8. Dispute resolution

Any dispute arising out of or relating to the Program — between you and LOARANA, or between you and any third-party provider transmitting messages on our behalf — is governed by the dispute resolution section of our Terms of Service, including the agreement to arbitrate individually, the class-action waiver, and your right to opt out of arbitration within 30 days.

9. State-specific provisions

Florida. We endeavour to comply with the Florida Telemarketing Act and the Florida Do Not Call Act as they apply to Florida residents. For compliance purposes you agree we may treat you as a Florida resident if, at the time you opted in, your shipping address was in Florida or your phone number carried a Florida area code. If neither applies, you agree not to assert Florida residency unless you tell us in writing. Where you are a Florida resident, you agree that messages we send in direct response to your own messages or requests — keyword replies, opt-in confirmations, HELP and STOP responses, and shipping notifications — are not telephonic sales calls or commercial telephone solicitation calls under Florida Statutes Section 501, including sections 501.059 and 501.616.

Washington. We endeavour to comply with the commercial telephone solicitation requirements of the Revised Code of Washington, including sections 80.36.390, 19.158.040, 19.158.110 and 19.158, as they apply to Washington residents. You agree we may treat you as a Washington resident if the phone number used to opt in carried a Washington area code.

Oklahoma. We endeavour to comply with the Oklahoma Telephone Solicitation Act of 2022 as it applies to Oklahoma residents. You agree we may treat you as an Oklahoma resident if the phone number used to opt in carried an Oklahoma area code. If it did not, you agree not to assert Oklahoma residency unless you tell us in writing. Where you are an Oklahoma resident, you agree that messages we send in direct response to your own messages or requests are not telephonic sales calls or commercial telephone solicitation calls under Oklahoma Statutes Title 15, including sections 775C.1 through 775C.5.

10. General

If any part of these terms is unenforceable, it is limited or removed to the minimum extent necessary and the rest stays in force. Our not enforcing something once does not waive it. We may update these terms; the date at the top will change, and continuing in the Program after an update means you accept it.
